Aam Aadmi Party (AAP) leader and Delhi Deputy chief minister Manish Sisodia received a notice from East Delhi Returning Officer K Mahesh for Tweeting about the religion and caste of Atishi, the East Delhi candidate from Aam Aadmi Party. The returning officer has asked Sisodia to submit the response till Wednesday evening.
A complaint was lodged by Bharatiya Janata Party (BJP) unit members Subhash Sachdeva, Aarti Mehra, and R.P Singh on April 28 against the legal name of Atishi who has changed her surname from “Marlena.”
On April 27, Mr. Sisodia had tweeted in support of AAP East Delhi candidate Atishi and hit out at her detractors who raised controversy over her last name and religion.
While tweeting in support of Atishi, Manish Sisodia said that both the BJP and the Congress are spreading lies about her religion. “Her full name is Atishi Singh and She is a Rajputani, A full-fledged Chhatrani. A Jhansi ki Rani.” He added saying that “Beware, she will win the elections.”
The notice issued by the returning Officer read that the tweet “appears to be in violation of Point (I) Annexure-I of the Manual on Mode Code of Conduct.” He also stated that the tweet prima facie attracts Section 123 of the Representation of People Act that deals with promoting the prospects of a particular candidate using his/her caste, religion, community, or race.
According to the Model Code of Conduct, the tweet appears to be in the violation that prohibits parties and the candidates from engaging in activities that aggravate existing differences, create mutual hatred between communities or cause any tensions between the different castes.
Miss Atishi’s name was dragged into the controversies when she dropped her legal last name ‘Marlena’ before the start of the election campaign, however, she still continues to file her legal affidavits in the name of Atish Marlena.
The seven Lok Sabha seats in Delhi will go to polls in the sixth phase of the Lok Sabha elections on May 12. The results will be announced on May 23.
